Banking and finance expert Kathleen Faulkner has joined private credit fund manager Msquared Capital as GC.

As GC, she is set to manage all aspects of the company’s legal responsibilities. In particular, she will also concentrate on collaborating with external legal partners to continually enhance documentation and investor protection.

Faulkner comes in with more than 12 years in the field under her belt. She has handled matters covering the full lifecycle of finance transactions – debt, corporate, acquisition, real estate, construction, and development.

Msquared Capital explained that appointing a GC “demonstrates Msquared Capital’s commitment to strong lending due diligence, helping to generate strong risk-adjusted returns”.

“The Australian private credit market has grown considerably in recent years due to several factors including changes to bank lending practices and regulations, and increased borrower awareness of the opportunity in private lending”, the company said in a media release. “However, not all private offerings are the same and they differ in terms of their risk profiles.

Consequently, there has been a growing focus on the importance of risk in the market”.

Faulkner added that “while the private credit market has experienced rapid growth in Australia, there remain risks for investors if legal protections are not properly executed and enforced”

“I am excited to join the Msquared Capital team and lead all legal matters and ensure there are stringent processes in place to protect our investors’ best interest”, she said. “Msquared Capital’s consistent emphasis on best practice was a key factor in my decision to join the firm.”

Faulkner was previously a partner at JHK Legal.
