Federal Court welcomes Craig Lenehan as NSW judge

The sitting federal government has announced the appointment of Craig Lenehan as a judge of the Federal Court of Australia, New South Wales registry, as of 9 February 2026. 

“I congratulate Mr Craig Lenehan SC on his appointment and thank him for his willingness to serve the Australian community,” said Michelle Rowland, Australia’s attorney-general, in a media release. 

According to the media release from Australia’s attorney-general, Lenehan’s appointment followed an open call for expressions of interest and an advisory panel’s assessment. 

Lenehan’s CV provided information regarding his professional experience and educational background. 

He gained admission as a legal practitioner to the Supreme Court of New South Wales in 1994, signed the New South Wales bar roll in 2006, and accepted an appointment as senior counsel in 2019. 

Legal work

Lenehan has worked as a barrister at 5 St James Hall and Banco Chambers in Sydney, NSW. 

At the bar, he maintained a broad public law practice, which focused on constitutional and administrative law matters, as well as appellate work. As a barrister, he has handled cases involving the following: 

  • standing and privity of contract 
  • the aliens power in s 5(xix) of the Australian Constitution 
  • issues arising from the execution of a warrant 
  • the implied freedom of political communication 
  • restrictions imposed during the state of emergency arising from the pandemic 
  • the issue of whether to imply intra-state freedom of movement in the Constitution 
  • a plaintiff’s representations regarding non-refoulement obligations in making non-revocation decisions under s 501CA(4) of the Migration Act 1958 (Cth) 
  • the ‘behaviour concern non-citizen’ criterion for special category visas in the Migration Act 
  • an application for access to personal letters to the Queen, held by the Australian archives 

Before joining the bar, Lenehan served as a solicitor at Freehills. He has been: 

  • a member of the NSW Bar Association’s Human Rights Committee and the Australian Bar Association’s Ethics Committee 
  • a senior legal officer and the deputy director of legal services at the Human Rights and Equal Opportunity Commission (currently the Australian Human Rights Commission) 
  • a fellow of the Gilbert + Tobin Centre of Public Law at the University of New South Wales Faculty of Law and Justice 

Education

Lenehan holds LLB and BS degrees. He received the Con Varnavas prize for the highest aggregate score in the bar exams and the Corrs Chambers Westgarth scholarship in law at UNSW. 

He also received the Le Fevre prize for physical chemistry and the final year physical geography prize at Macquarie University.
